Welcome to Jacobs-MC ("Jacobs," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at https://jacobs-mc.co and https://jacobs-mc.eu (the "Site"), as well as the purchase and use of our products. By accessing the Site or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products.

For EU customers, these Terms are issued by Jacobs Integrity Technologies, UAB, located at Darbo sq. 5, LT-35220 Panevezys, Lithuania. For non-EU customers, these Terms are issued by Jacobs-MC, located at 28 Emerald Ct Satellite Beach, Florida 32937.

1. Acceptance of Terms

By accessing the Site, creating an account, submitting a form, or purchasing products, you agree to these Terms and our Privacy Policy. These Terms apply to all users, whether registered or not. If you are purchasing on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:

Violate any applicable laws or regulations.

Infringe the rights of others.

Attempt unauthorized access to any part of the Site.

Use the Site in a way that could disable, overburden, damage, or impair it.

Use automated means (e.g., bots, scrapers) to access or collect data from the Site.

We reserve the right to suspend or terminate your access to the Site if you violate these Terms.

3. Products and Orders

3.1 Product Information

We sell professional water leak detection equipment, including the Sniffer430 (tracer gas detector) and Lixener30 (acoustic detector). Product descriptions are provided on the Site, but we do not warrant that they are free of errors. Contact us at team@jacobs-mc.co for clarification before ordering.

3.2 Pricing

All prices are displayed in USD for non-EU customers and EUR for EU customers, or other local currencies, inclusive of applicable taxes (e.g., VAT for EU customers, calculated at checkout based on your location). Additional costs (e.g., shipping, customs duties) will be clearly shown before you complete your purchase.

3.3 Payment

We accept payments via Klarna and Affirm (for split payments and financing), credit/debit cards, and other methods as indicated at checkout. All payments are processed securely in compliance with the EU Payment Services Directive (PSD2). For EU customers, strong customer authentication (SCA) may be required.

3.4 Order Process

Orders are subject to acceptance and availability. We may refuse or cancel orders due to inventory shortages, payment issues, or suspected fraud. You will be notified if an order cannot be fulfilled, and any payments will be refunded.

3.5 Shipping

We aim to ship orders within 1–2 business days from our US distribution center in Florida or EU facilities (Lithuania), provided inventory is available. If inventory is unavailable, we will restock within 7-10 days and notify you of updated shipping times. Delivery to EU customers will occur within 30 days unless otherwise agreed. Shipping costs and estimated delivery times are provided at checkout.

4. EU Consumer Rights (For EU Customers Only)

4.1 Right of Withdrawal

If you are an EU consumer, you have the right to withdraw from your purchase within 14 days from the day you receive the product, without giving a reason. To exercise this right:

Notify us at sales@jacobs-mc.com or team@jacobs-mc.co within 14 days of receipt.

Return the product in its original condition, unused, and in its original packaging.

You bear the cost of return shipping unless the product is defective.

We will refund the purchase price (excluding original shipping costs) within 14 days of receiving the returned product.

This right does not apply to custom-made products or products that cannot be returned for hygiene reasons, as specified at the time of purchase.

4.2 Legal Guarantee

EU consumers are entitled to a 2-year legal guarantee for products that are defective or not as described. This is in addition to our 1-year manufacturer warranty (see Section 5). If a product is defective, contact us at sales@jacobs-mc.com to arrange repair, replacement, or a refund, as required by EU law.

5. Manufacturer Warranty

Our products (Sniffer430, Lixener30) come with a 1-year manufacturer warranty covering defects in materials or workmanship. This warranty does not cover damage due to water, dust, mechanical impacts, or misuse (e.g., dropping the device). To make a warranty claim:

Ship the product to our US service center at 28 Emerald Ct Satellite Beach, Florida 32937 or, for EU customers, our EU facility at Darbo sq. 5, LT-35220 Panevezys, Lithuania.

Repairs are typically completed the same day we receive the product, and it will be shipped back to you promptly. After the warranty expires, repairs may incur costs for parts.

6. Intellectual Property

The Site, its content (e.g., text, images, videos), and our products’ designs are owned by Jacobs-MC via Consumer Dynamics Partners LLC and are protected by international copyright, trademark, patent, and other intellectual property laws. You may temporarily download product manuals or demo videos for personal, non-commercial use, but you must not:

Modify or copy the materials.

Use them for commercial purposes or public display.

Reverse-engineer our products or software.

Remove any copyright or proprietary notices.

Transfer or mirror the materials on another server.

Your license to use these materials terminates if you violate these restrictions or upon our request.

7. Disclaimer of Warranties

The Site and our products are provided "as is" and "as available," without warranties of any kind, except as provided in Section 4.2 (EU Legal Guarantee). We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law. We do not guarantee that the Site will be error-free, secure, or uninterrupted, or that product descriptions are free of errors.

8. Limitation of Liability

To the fullest extent permitted by law, Consumer Dynamics Partners LLC and Jacobs Integrity Technologies, UAB shall not be liable for indirect, incidental, special, consequential, or punitive damages (e.g., loss of profits, data, or business opportunities) arising from your use of the Site or our products. Our liability for defective products is limited to repair, replacement, or refund, as outlined in Sections 4.2 and 5. Some jurisdictions (e.g., EU countries) do not allow certain limitations, and such local laws will prevail.

9. Indemnification

You agree to indemnify and hold harmless Jacobs-MC via Consumer Dynamics Partners LLC, Jacobs Integrity Technologies, UAB, and their officers, directors, employees, and agents from any claims, damages, or costs (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site or our products.

10. Marketing Communications

By submitting a form or purchasing a product, you consent to receive emails or SMS about product updates, promotions, or newsletters. You can unsubscribe at any time via the opt-out link in our emails or by contacting us at team@jacobs-mc.co. We comply with GDPR and the ePrivacy Directive for EU customers and do not send unsolicited commercial emails.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Lithuania for EU customers and Florida, US for non-EU customers, without regard to conflict of law provisions. EU consumers may also rely on their local consumer protection laws.

11.2 Online Dispute Resolution (EU Customers)

EU consumers can resolve disputes via the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/. Contact us at team@jacobs-mc.co to resolve issues directly before escalating to the ODR platform.

12. Changes to Terms

We may update these Terms at any time without notice. The updated Terms will be posted on the Site with the revised date. By continuing to use the Site or purchase products, you agree to the updated Terms. We recommend reviewing these Terms regularly.
